1. Acceptance of Terms

By accessing or using CardITvisio ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Service Description

CardITvisio is a web-based application that allows users to:

  • Upload images to create custom cards and labels
  • Use preset templates (poker cards, tarot cards, Avery® labels, etc.)
  • Generate print-ready PDF files with professional features including bleed, crop marks, and precise measurements
  • Export files suitable for home printing or professional print shops

The Service is provided on a freemium basis, with certain features requiring a paid subscription.

3. User Responsibilities

You agree to:

  • Provide accurate information when creating an account
  • Maintain the security of your account credentials
  • Use the Service only for lawful purposes
  • Not upload content that infringes on others' intellectual property rights
  • Not upload illegal, harmful, or offensive content
  • Not attempt to reverse engineer, modify, or interfere with the Service
  • Not use automated systems to access the Service without permission

Content Rights

You represent and warrant that you own or have the necessary rights to use any images you upload. You are solely responsible for ensuring your content does not violate any third-party rights, including copyright, trademark, or privacy rights.

4. Intellectual Property

Our Property

The CardITvisio platform, including its design, templates, software, trademarks, and all associated intellectual property, is owned by CardITvisio and protected by applicable laws.

You may not copy, modify, distribute, or create derivative works from our platform without explicit permission.

Your Property

You retain all ownership rights to images and content you upload. We do not claim any ownership or license rights to your content beyond what is necessary to provide the Service.

5. Trademark Notice

Avery® is a registered trademark of Avery Products Corporation. All other product and company names mentioned are trademarks™ or registered® trademarks of their respective holders.

CardITvisio is not affiliated with, endorsed by, or sponsored by Avery Products Corporation or any other label or card manufacturer. Template names referencing third-party products are provided solely for compatibility reference purposes.

6. Service Availability & Changes

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical issues or outages
  • Updates and improvements
  • Factors beyond our control

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

7. Print Disclaimer

Important: Please Read Carefully

CardITvisio generates files based on templates and your input. Actual printed output may vary depending on your printer, print provider, paper stock, and settings.

You acknowledge and agree that:

  • Output Variations: Generated PDF files are designed for standard printing specifications, but results may vary across different printers, software, and print services.
  • User Responsibility: You are responsible for reviewing all files before printing, including checking alignment, margins, colors, and overall layout.
  • Test Prints: We strongly recommend performing test prints on standard paper before committing to final production runs, especially for large quantities.
  • Color Accuracy: Screen colors may differ from printed colors. Color management and calibration are your responsibility.
  • Print Provider Requirements: Different print shops have different specifications. Verify compatibility with your print provider before ordering.

Limitation of Liability for Printing

CardITvisio is not responsible for:

  • Printing errors, misalignments, or color discrepancies
  • Costs associated with failed or unsatisfactory print runs
  • Print provider fees, materials, or production costs
  • Any losses resulting from printed materials not meeting expectations

By using the Service, you accept full responsibility for verifying all output files before printing and for any costs incurred.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of output

We do not warrant that the Service will meet your requirements, be error-free, or operate without interruption.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDITVIZIO SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, business opportunities, or goodwill
  • Damages arising from reliance on the Service
  • Damages exceeding the amount you paid to us in the 12 months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms.

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account data (subject to legal retention requirements)
  • Provisions that should survive termination will remain in effect

11. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through:

  1. Negotiation: Good faith discussions between parties
  2. Mediation: If negotiation fails, through a mutually agreed mediator
  3. Arbitration: Binding arbitration under South African law

Consumer Protection: These Terms do not limit any mandatory consumer protection rights you may have under the laws of your jurisdiction. If you are a consumer in the EU, UK, Australia, or other jurisdiction with mandatory consumer protections, those protections apply regardless of the governing law stated above.
